On Tuesday, 1 May 2018, the Ministry of Justice confirmed that amendments had been made to the Pre-action Protocol for Debt Claims and the Pre-action Protocol for Professional Negligence. With effect from 30 April 2018:
- the Pre-action Protocol for Debt Claims, para 3.1(d) now directs users to the Money Advice Service where copies of the most up to date versions of the Standard Financial Statement can be obtained
- the Pre-action Protocol for Professional Negligence claims, para 6.2 which deals with the letter of claim has a new sub-paragraph (i), which states that the letter of claim is required to give an indication whether the claimant wishes to refer the dispute to adjudication. If they do, they should propose three adjudicators or seek a nomination from the nominating body. If they do not wish to refer the dispute to adjudication, they should give reasons
